Olmsted County Bar Association
  • Our next Bar meeting has been rescheduled to 5:30 p.m. on Thursday, October 29, to accommodate our speaker's schedule.
    • Speaking of our guest, Mayor Kim Norton will be joining us to share the latest news in the City of Rochester.
  • We also are excited to announce our Members in Masks social gathering at 4:00 p.m. on Friday, October 23!
    • We will be gathering outdoors at Forager Brewery and adhering to CDC guidelines and applicable state laws.
    • Masks are required when food/drinks are not being consumed.
    • We look forward to seeing you!


Legal Assistance of Olmsted County
  • It's not too late to register for the 5K Run/Walk fundraiser for Legal Assistance of Olmsted County.  Go to their website at www.laocmn.org to register.  
  • Don't miss out on the silent auction!  Click Bid makes it so easy to participate.  You can register for the silent auction and view baskets by going to www.LAOC.CBO.IO.  There are 45 amazing baskets.  Four of them are described below.

Olmsted County Law Library
  • Did you know?
    The Olmsted County Law Library has, right on its shelves, Minnesota Civil Practice, Fourth Edition!  This is an excellent resource for any attorney, but especially if you are new to practice or new to the issue at hand.  Minnesota Civil Practice has been described as one of the most detailed resources on civil procedure compared to any other.  Three volumes cover everything from the history of litigation in Minnesota, to plaintiff’s pleadings, to extraordinary writs.  Stop into the Olmsted County Law Library and check it out.  The law library is open Monday – Friday, 8:30 a.m. – 4:30 p.m.

Olmsted County Bar Association
  • The Honorable A.M. "Sandy" Keith passed away Saturday, October 3, 2020.

    • The Board will be making a donation on behalf of the OCBA in Justice Keith's memory.
  • For those of you advising small business owners and others struggling financially during COVID:
    • RPU has allocated $750,000 to help Rochester small  business customers with utility bills.
      • The small business financial assistance program was launched in early August with an initial amount of $500,000 to help small businesses with their utility bills. The response from customers was so positive that an additional $250,000 has been added for allocation. Over 344 local small businesses have been approved for financial support already.
      • The CARES (Coronavirus Aid, Relief, and Economic Security) Act enacted on March 27, 2020, has appropriated $150 billion to the Federal Coronavirus Relief Fund (CRF), which can be used towards paying customer utility bills that incurred during the period of March 1, 2020 through December 31, 2020. Rochester has already received over $8.8 million CRF dollars from the State.  
      • In addition to providing assistance to locally owned small businesses including designated funding for women, minority, and veteran owned local businesses (WMBE), RPU also has $187,500 for residential customer financial support through working in conjunction with Olmsted County and Three Rivers Communication Action. To date, there have been 10 applicants approved for assistance totaling almost $7,000. 
      • Applications must be submitted for approval by October 16, 2020.

  • If you haven't already registered to participate in LAOC's 5K run/walk fundraiser, please do so today!  Visit LAOC.Eventbrite.com to register!  And if you don't want to run or walk a 5K in support of LAOC, you can still participate in the Silent Online Auction.  To view and bid on any of the amazing 45 baskets available, register for the auction on the ClickBid website at LAOC.CBO.IO.  LAOC will feature details about the baskets on their FB page October 5th through the 16th.  Here is a sneak peak at a few items up for auction:
    • Basket #34:  Chef Vincenzo Cooking Class.  No one cooks Italian like Chef Vincenzo!  Learn the magic of Italian cooking as he will host a cooking class featuring a 3-course menu for 4 to 6 people.  Not comfortable doing this in-person?  Chef Vincenzo will do a virtual class for you!
    • Basket #35:  Judge Chase’s Lincoln Drawing.  This item needs no introduction to many Olmsted County attorneys!!  The Honorable Judge Joseph Chase has contributed a drawing of President Lincoln for the LAOC fundraiser for many years.  The bidding for this drawing will be competitive!  Don’t miss your opportunity to bid on this one!  
    • Basket #39:  Tee Time!  This tee time requires golf clubs not a tea bag!  Enjoy a round of golf for 4 at Somerby’s legendary golf course, complete with golf carts.  Then relax in the Chophouse for a beautiful, gourmet dinner.  This basket also includes two beautiful wine glasses and a bottle of wine.

  • Thank you to everyone who attended our first meeting of the Bar year last Thursday!  For those of you who couldn't attend:
    • Our next meeting is via Zoom at 12:00 p.m. on Friday, October 23.

    •  We are exploring options for a socially distanced, outdoor gathering before the weather gets too cold.

      • Marc is the new attorney at SMRLS and, among other things, will be handling housing law cases.
 
Bird, Stevens, & Borgen, P.C.
  • Bird, Jacobsen & Stevens, P.C. has added a shareholder and changed its name. The firm is now known as Bird, Stevens & Borgen, P.C.  The name change comes as the firm welcomes Attorney Grant Borgen as a shareholder.
  • Bird, Stevens & Borgen, P.C. will continue to operate as a five-lawyer firm, with the following trial lawyers representing clients in litigation matters: Charles Bird, Jeremy Stevens, Grant Borgen, Van Jacobsen, and Danielle Bird.  The firm will continue its long tradition of handling injury cases in Minnesota, Wisconsin, and Iowa as well as its national agricultural litigation practice. The firm will continue to serve clients who have work injuries, criminal charges, or disabling conditions that qualify for social security disability benefits.
  • Van Jacobsen continues as the firm’s managing attorney, a role that he has held for decades. Mr. Jacobsen also maintains his full-time practice, which is focused on social security disability and workers’ compensation claims. 
  • Bird, Stevens & Borgen, P.C. will continue to operate offices in Rochester, MN and Bloomington, MN.  The firm has a new website (www.bsbjustice.com) and email addresses (<firstname>@bsbjustice.com), but physical addresses, phone numbers, and fax numbers remain the same.  Emails sent to former email addresses will be forwarded appropriately.
  • Bird, Stevens & Borgen, P.C. is excited for this new chapter and continuing its rich history of helping clients achieve a successful resolution to their cases.

    • The Olmsted County Law Library has a standing order for ALL Minnesota CLE material.  This means the law library has dozens of super helpful Minnesota CLE Deskbooks on our shelves, as well as InFORMed Annotated Legal Documents, and “Quick Answer” books.  Some especially popular Deskbook titles in the law library are Drafting Wills & Trust Agreements, Minnesota DWI Deskbook, Guardianship & Conservatorship Law Handbook, and the Family Law Institute.  Stop in to see the selection.  The law library is located on the 5th floor of the Government Center.
    • Attorneys can check out print material from the law library.
    • Law library hours are Monday-Friday, 8:30 – 4:30, with law librarian assistance available.

Legal Assistance of Olmsted County
  • It is with regret that LAOC has decided to cancel its rescheduled Night in Monte Carlo fundraiser for this year.
    • As much as we love this event, we do not feel comfortable hosting an in-person event of that size under the current circumstances.
  • BUT!  We are excited to announce our Virtual 5K taking place the week of October 10 through October 17!

Legal Assistance of Olmsted County
  • Legal Assistance of Olmsted County is pleased to announce that it received a $10,000 COVID relief grant from the Minnesota State Bar Foundation for its work providing civil legal aid during the pandemic.  Thank you to the MSBF for its generosity.
  • LAOC always can use new volunteers!  The time you donate to help someone in poverty with a civil legal problem makes a big difference.  Opportunities include:
    • Staffing a virtual clinic (only a two-hour time commitment!);
    • Providing a one-time consultation to a client; or
    • Taking a case for full representation.
  • To our current volunteers who have provided valuable assistance during the pandemic-- a HUGE SHOUT-OUT!  Thank you!

  • The Law Library is now open!  Here are some of the changes:
    • No more than two patrons in the library at a time.
    • Public terminals are available by appointment.
    • Face masks are required.
  • Did you know?
    • Print material in the Law Library is available for attorneys to borrow and use offsite.
    • The Law Library maintains a Westlaw subscription for free public use.
    • We have several Minnesota based titles, including: Minnesota Family Law Practice, Minnesota Residential Real Estate, Stein on Probate, Minnesota Civil Practice, Dunnell's Digest, and more! 
    • A law librarian is available from 8:30 a.m. to 4:30 p.m., Monday through Friday.  Email us at staff@olmstedlawlibrary.com, call us at 507-281-3778, or visit our website at www.olmstedlawlibrary.com.

Olmsted County Bar Association
  • Congratulations to our colleague, Steve Murakami!  
    • On Thursday, July 23, Steve was awarded the prestigious Raeder Larson Public Service Award.
    • Steve was nominated for this honor by his MSBA colleagues in the Bankruptcy Section.
    • The award recognizes Steve's ongoing commitment to pro bono service in the area of bankruptcy law.

  • Mike Walters, our representative on the Olmsted County Justice Council, passed along the following information from the Olmsted County Sheriff's Office regarding Department of Corrections writs:
    • DOC facilities are restricting the availability of inmates for court appearances based on the presence of COVID in their prison populations.
    • DOC is encouraging attorneys and judges to prioritize remote appearances for their inmates.
    • The Sheriff's Office stated the following about its coordination with DOC:
      • If we have a new commit or a writ from a DOC facility, we will be contacting them beforehand to see what the current status is of the facility and inmate. We ask that if you have a writ (defendant or witness) to submit it to us as soon as possible (which most of you have been doing, thank you) so we can consult with the DOC on the status of the inmate and the possibility of bringing them for the hearing. If you need to cancel a writ or a hearing in which a writ was used, please let us know right away so we can cancel and notify the DOC. Anytime an inmate leaves the facility and returns they need to be put in quarantine to be monitored, which is not what most inmates want. We will do what we can but will need to follow the direction/information we get from the DOC. New commitments will either need to stay local a little longer or go to an alternate facility instead of St. Cloud. We of course will not transport any inmate who is positive for COVID.
