LAOC
  • Mark your calendars for March 19 and 20!  LAOC is partnering with Bleu Duck Kitchen to offer dinner packages for an early spring fundraiser.

Minnesota Judicial Branch
  • Chief Justice Gildea issued a new order on February 18 regarding COVID-19 procedures.  
    • The new order will take effect Monday, March 15.
    • Criminal jury trials will be permitted to occur in person effective that date.
    • Civil jury trials will be permitted to occur in person if parties agree and with the Court's permission.

  • Michael Walters, our representative on the OCJC, reported the following from Olmsted County Public Health:
    • Olmsted County businesses, including law firms and non-profit businesses, are encouraged to go to https://www.olmstedcounty.gov/covid/vaccine and click on “COVID-19 Vaccination Planning for Businesses” to file a vaccine planning form.  
      • Private-sector attorneys who have a speedy jury trial scheduled are particularly encouraged to complete the form. This does not guarantee higher priority for vaccination, but it will allow public health authorities a more complete picture of the vaccination needs for in-person court.
      • Government-employed attorneys (public defenders, county attorneys, etc.) should not use this form; government law offices are working directly with public health authorities for distribution of vaccines.


Olmsted County District Court
  • The Bench and Court Administration have decided to extend the current suspension of in-person hearings through the end of May.
    • Exceptions for jury trials will be granted in accordance with Chief Justice Gildea's order of January 21, 2021.

Olmsted County Law Library
  • The Law Library has written a letter in support of LAOC's 2021 funding request.
    • The request is up for discussion at the Bar meeting this Thursday, February 11.

  • Our next Bar meeting is at 5:30 p.m. on Thursday, February 11, via Zoom.  Agenda items include:
    • A discussion of LAOC's funding request for 2021 in the amount of $12,000; and
    • A presentation from Naquita Niles, Program Manager for Olmsted County's new Diversity, Equity, and Outreach Program.
  • We are seeking volunteers to serve on our Scholarship Committee for 2020-21.
    • Committee members review applications and assist in choosing scholarship recipients.
    • Time commitment is nominal.

Olmsted County District Court

  • Chief Justice Gildea issued a new order on Thursday, January 21, regarding COVID restrictions on district court proceedings.  The highlights are as follows:
    • No new in-person criminal jury trials before March 15 unless an exception is granted by the district's chief judge because:
      • Speedy trial has been demanded,
      • Defendant is in custody, and
      • Case involves either a felony crime or non-felony person crime.
    • No new in-person civil jury trials before March 15 unless an exception is granted by the district's chief judge with consultation and permission of the Chief Justice.
  • Additionally, the Olmsted County Bench has decided that all hearings, other than those meeting criteria for an exception, will be held remotely until March 31.

  • Thanks to everyone who attended our January meeting last week.  Highlights included:
    • The announcement that the membership voted to increase the amount of each annual scholarship to $2,500 for the 2020-21 Bar year; 
    • Referee Baker's introduction of her new law clerk, Jonathan Snyder; and
    • Referee Baker's informative presentation on HRO's and OFP's.

I.          Introductory Remarks from President Lindberg
  • Call to order

IV.       New Business
  • Ugly Sweater Contest!
    • First round: tie between Ms. Whalen and Referee Baker.
    • Final round: Referee Baker wins for “having most appalling outfit.”
  • Results of first vote to increase scholarship
    • Approved by 72% of the 65 members who voted.  47 for, 18 against.
    • Discussion of scholarship increase.
      • Ms. DiFiore presented rationale for increasing scholarship awards.
        • This isn’t an either/or contest between scholarships and LAOC.
        • We are able to do both.
      • Mr. Novack explained financial ability to pay for this year.
        • We’ve only spent $1000 so far this year.
        • We have plenty of reserves to continue this year even if things move forward.
        • We would have spent this much already on other things and still have funds for LAOC.
      • Referee Baker
        • Opposed because of special role between OCBA and LAOC.
        • Doesn’t think scholarship increase is sustainable.
        • There’s a difference between helping two people and dealing with 200% increase in people who need civil legal services.
        • LAOC needs the money as much or as more now.
        • Wants to amend vote to include language that restricts increase to one year.
      • Mr. Lipford
        • Opposed because of special role LAOC plays in our county.
        • He runs SMRLS in eleven counties; Olmsted is the only bar he doesn’t ask for money.
      • Ms. Dobson
        • In favor.
        • Concerned about sustainability.
        • Hopes that $2500 in future years can be part dues, part individual or firm donations.
      • Ms. Plante
        • In favor.
        • Ms. Johnson unable to attend tonight, but communicated she is in favor; her thoughts are consistent with Ms. Dobson’s.
        • Point of clarification: LAOC hasn’t made request yet; they are welcome to do so if/when they need money.
        • Point of clarification: bylaws don’t provide for change of voting issue midway through voting process.
      • Ms. Griffin
        • In favor.
        • Wants to make sure we make a meaningful contribution in whatever we undertake as a group.
        • She would like to see us to do that with LAOC, too.

        • Each expenditure goes before membership every year, so no reason to amend current issue before membership.

    • The vote will be conducted by electronic ballot unless you opt out via written communication to olmstedcountybarassociation@gmail.com.

Olmsted County District Court
  • Court Administrator Holland and the Bench have promulgated instructions for filing court exhibits for Zoom Hearings.
    • The instructions are as follows:
      • "All exhibits you wish to submit to the court during the hearing must be provided by email to olmsted.courts@courts.state.mn.us TWO BUSINESS DAYS before your hearing by 4:30 p.m. If for some reason you are unable to provide your exhibits in an electronic format you must send an email to the same email address by the deadline above."
      • "Witnesses may testify by ZOOM. It is your responsibility to provide the necessary ZOOM information to your witnesses. The court will not contact witnesses."

  • Thank you to everyone who joined us for our Bar meeting last Friday!  Highlights included:
    • The announcement that the first vote to increase the annual scholarship awards to $2,500 each passed by a 72% majority.
    • The announcement that Mr. Terry Adkins was unanimously approved to fill the at-large vacancy on the Board of Directors.
      • Please join us in congratulating and welcoming Terry to the Board!
    • The award of bragging rights to Referee Gail Baker for winning the first annual OCBA Ugly Sweater Contest!
  • Mark your calendars for the next Bar meeting at 5:30 p.m. on Thursday, January 14, 2021, via Zoom.
  • The second vote on scholarship will start next Monday, December 21, 2020, and run for one week through December 28, 2020. 
    • Pursuant to OCBA Resolution 2020-1, the vote will be conducted by electronic ballot unless you opt out of voting by notifying the OCBA at olsmtedcountybarassociation@gmail.com.
  • A reminder about dues: 
    • Pursuant to Article I, Section 4(B), any member who fails to pay his or her dues in full within 90 days of receiving a dues invoice "shall" have his or her membership terminated.
    • Terminated members are not permitted to attend meetings.  
    • Terminated members are not permitted to vote on Bar business.
    • Any members who have not paid dues in full by next Monday, December 21, will have their membership terminated and their names removed from the roster until payment is received.
 
Legal Assistance of Olmsted County
  • LAOC wishes to thank all the volunteers in 2020 who donated their time and talent to those in poverty needing civil legal aid!  LAOC is now seeking attorneys who are willing to take pro bono cases or one time consults and/or to staff legal clinics, particularly family law clinics.  While completely understanding how busy you are, we urge all family law practitioners to consider staffing a family law clinic through the law library.  These are all virtual and will only take 2 hours of your time – no preparation is necessary.  Without your help, these clinics cannot be staffed and LAOC’s funding is dependent upon regularly staffing these clinics.  Now more than ever, your generous donation of time and talent to those needing civil legal aid is critical.  Want to help?  Email Victoria@laocmn.org.  THANK YOU.  And we wish you a happy holiday season.
